1.Definitions
1.1 The term "client" refers to private individuals who register for continuing education, or legal entities registering on behalf of a natural person for continuing education.
1.2 The term "provider" or "Thomas More" refers to the organizer of continuing education, whether it is an individual staff member or the organizing department of Thomas More.
1.3 The term "continuing education" refers to the entirety of refresher and supplementary training programs (excluding bachelor's degree programs, post-bachelor programs, associate degree programs, and postgraduate programs) intended for professional purposes. These can take various forms, such as lectures, study days, workshops, training programs, lecture series, conferences, etc., even if they are referred to by another name.
2.Scope of Application
2.1 These general registration terms and conditions apply to any registration for continuing education offered by Thomas More, whether paid or free, unless a legal or regulatory provision determines otherwise, or unless expressly and in writing deviated from in an individual agreement.
2.2 These general registration terms and conditions are considered accepted by the client by the mere act of registering for continuing education, even if they conflict with the client's own general or specific purchase conditions. The latter are only binding on Thomas More if they have been expressly and in writing accepted by Thomas More.
2.3 The provider reserves the right to amend its general registration terms and conditions without personally notifying the client and without the client being entitled to any compensation. However, for ongoing agreements, the general registration terms and conditions that were applicable at the time the agreement was concluded shall remain in force.
2.4 The text of these registration terms and conditions is available on the Thomas More website and will be sent to any interested party upon request.
3.Registration
3.1 The client can register through the registration option provided (in writing) by the provider.
3.2 The client can register until the final registration deadline specified by the provider of the respective continuing education. Registrations after this specified date may be declined. If no explicit final registration deadline is mentioned by the provider, the (start) date of the activity shall serve as the final registration deadline.
3.3 The representative, employee, spouse, or any other family member of the client represents the client and is presumed to have the necessary authorization to bind the client to the provider.
3.4 By registering, the client agrees to these general registration terms and conditions.
4.Cancellation of Registration
4.1 The client may modify or cancel their registration in writing (by regular or registered letter or by email), subject to the conditions below. They can use the following form for this purpose: https://economie.fgov.be/sites/default/files/Files/Ventes/Forms/formuli….
4.2 Cancellation of registration up to fourteen (14) calendar days before the (start) date of the continuing education is generally free of charge, but costs already incurred at the time of cancellation (course materials, meals, etc.) will be charged by the provider. In the case of cancellation less than fourteen (14) calendar days before the (start) date of the continuing education, the full price of the continuing education will be charged.
4.3 For cancellations less than fourteen (14) calendar days before the (start) date of continuing education offered free of charge or for less than 25 euros, the provider may charge an administrative fee of 25 euros.
4.4 Cancellation refers to withdrawing and/or not attending the continuing education for any reason whatsoever.
4.5 Anyone registered for continuing education but unable to participate may be replaced at no additional cost, provided the provider does not object. Replacement can only occur after written notification from the client to the provider no later than 2 working days before the (start) date of the continuing education.
5.Participation Fees and Payment
5.1 The participation fees for continuing education are determined by the provider and stated in the announcement of the activity. The participation fees may be adjusted by the provider at any time without prior notice to the client. However, once the client has registered, the participation fee applicable at the time of registration will apply.
5.2 The method of payment for participation fees for continuing education is determined by the provider and mentioned in the announcement of the activity. The client may always request an invoice from the provider prior to paying the participation fee. Payment of an invoice must be made via transfer of the due amount to Thomas More's bank account, with the structured communication specified on the invoice.
5.3 The client is obliged to pay the invoices without deduction, withholding, or discount, within thirty (30) calendar days of the invoice date.
5.4 Any dispute regarding the invoice must be communicated in writing via registered mail within thirty calendar days of the invoice date. After this period, the client formally waives any protest.
5.5 In the event of late payment, the client owes, in addition to the principal sum, a reminder fee of 20 euros and, by operation of law and without the need for a formal notice of default, a late payment interest of 1% per month from the invoice date on the principal sum. In the event of persistent non-payment, the invoice will be forwarded to a collection agency. The collection costs will be borne by the student/client. In such cases, a compensation of 15% with a minimum of 40.00 euros will be charged. If an amicable settlement cannot be reached, legal proceedings may be initiated. Any additional court costs and legal assistance fees will, upon conviction, be entirely borne by the student/client.
6.Modification and Cancellation by the Provider
6.1 The provider may cancel the registration(s) placed by the client in case of force majeure, without the client being entitled to compensation, except for the reimbursement of the participation fees already paid.
6.2 The provider may also cancel the registration(s) placed by the client in cases where there are insufficient registrations or the lecturer(s) are unavailable, without the client being entitled to compensation, except for the full reimbursement of any participation fees already paid.
6.3 If the provider changes the time, date, location, or lecturer(s) of the continuing education, the client may cancel their registration free of charge, with reimbursement of any participation fees already paid, but without the client being entitled to compensation.
7. Intellectual Rights
Neither registration nor participation in the continuing education creates any right for the client to reproduce or disseminate the content or form of the continuing education.
8. Exclusive Jurisdiction – Applicable Law
8.1 Any dispute concerning the validity, interpretation, or execution of the agreements concluded and the present general terms and conditions falls exclusively under the jurisdiction of the courts of the judicial district of Antwerp.
8.2 Any dispute between the client and the provider is governed exclusively by Belgian law.
